Assumption of Risk
I acknowledge that the use of Be Kat Strong’s facilities, equipment, and participation in fitness classes, training sessions, or any other physical activities organized or offered by BKS involves inherent risks. These risks include, but are not limited to, physical injury, muscle strain, heart attack, illness (including exposure to contagious diseases such as COVID-19), disability, or death. I knowingly and voluntarily assume all such risks, whether foreseen or unforeseen.
Waiver and Release of Liability
To the fullest extent permitted by law, you agree to release, waive, and discharge BKS, its owners, officers, employees, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action related to any loss, damage, or injury (including death) that may occur while using our facilities or services, whether arising from negligence or otherwise.
This release applies to all claims, including those that arise before, during, or after your membership.
Indemnification
You agree to indemnify and hold harmless BKS and its affiliates against any and all claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your actions, breach of these Terms, or misuse of our facilities or equipment.
Medical Disclaimer
We are not licensed medical professionals. All information, classes, and personal training services provided are for general informational and fitness purposes only. It is your responsibility to consult a physician before beginning any exercise program. If you experience dizziness, chest pain, or shortness of breath during physical activity, stop immediately and seek medical attention.
Use of Facilities and Equipment
You agree to use all equipment and facilities responsibly, following all posted guidelines and staff instructions. Misuse or reckless behavior may result in suspension or cancellation of your membership.
Termination of Membership
We reserve the right to suspend or terminate your membership at any time for violations of these Terms, misconduct, or behavior deemed unsafe or disrespectful to others.
Use License
Permission is granted to temporarily download one copy of the materials (information or software) on BeKatStrong’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
